Purchasing Terms and Conditions

Hi and welcome to Mandurah Mowers and Cylinder Mowers WA.

Your use of mandurahmowers.com indicates acceptance of the following terms and conditions:

“We” and “us” refer to Wayne Lopaten trading as Mandurah Mowers and trading as Cylinder Mowers WA,

and “you” refers to you, our customer. These Terms and Conditions constitute the contract shared between us for your purchase of our goods. We reserve the right to update and change these terms and conditions, from time to time.

Correction of Errors and Inaccuracies

Whilst we make every reasonable effort to present accurate information on this web site, the

information may not be complete or up to date, and may contain typographical errors or

inaccuracies.

As a result, we reserve the right to correct, change or update information displayed on Mandurah

Mowers at any time, without prior notice. Please note that such errors, inaccuracies or omissions

may relate to product description, pricing and availability. You are responsible for evaluating the

accuracy and completeness of all information provided.

Legal Capacity To Transact

By accepting these Terms and Conditions you acknowledge that you must be over the age of

eighteen (18) years to place orders with Mandurah Mowers.

Payment Methods

We use Paypal Third party payment gateway providers to provide a secure environment for the

authorisation of credit card transactions. We use Secure Socket Layer (SSL) and payment gateway for

all orders placed to ensure the security of your personal card details. We do not keep any records of

your credit card details on file.

GST

All Mandurah Mowers sell prices include 10% GST where applicable.

Risk

Risk and Title in the products passes to you on the date and time of delivery to the delivery address.

Delivery Policy

After ordering online, you will receive an email confirmation from Mandurah Mowers

We will confirm receipt of your order within a few minutes of ordering. In stock products purchased

from Mandurah Mowers are shipped the next business day (Monday – Friday), standard delivery

times do apply.

Shipping fees are calculated based on the weight of the items in your shopping cart (unless they

specify free postage on items) and the final destination address.

We use Australia Post for smaller items, however larger / bulky items will be sent using a freight

company.

We do ship internationally.

Returns Policy

Our Returns Policy includes the rights you have under the Australian Consumer Law and provides

you with additional benefits in addition to those rights, because your satisfaction is important to us.

Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You

are entitled to a replacement or refund for a major failure and for compensation for any other

reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced

if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

All refunds will be issued when goods have arrived back to us and been assessed by a team member.

Please also provide proof of purchase, when your product is returned.

We are unable to accept the return, if the product is found to have no fault, or that the goods have

been damaged due to misuse by you. An additional fee will occur if this was to take place and you

will be liable for the return freight costs also.

At Mandurah Mowers, we always take a fair and reasonable approach to assess your returned good.

As you can appreciate, our response time will also depend on how long it takes you to return the

product to us.

We will pay for, or reimburse you for, any shipping costs to return the original product to us where,

following product assessment, we have been found to breach a consumer guarantee.

Refunds will be made by the same method of purchase.

Please note that Mandurah mowers does not accept returns for ‘change of mind’ purchases.

We always seek to list products with the most competitive prices. We reserve the right to change

prices for products displayed at mandurahmowers.com at any time before you place an order.

The price of products shown excludes shipping costs. Shipping costs are displayed on the checkout

page, and are calculated based on your location, the amount and type of items you place in your

shopping cart. The total price will be shown prior to payment.

Liability

Apart from liability which cannot be excluded by law, we exclude all implied terms and warranties

relating to the Site or the subject matter of this agreement. We will not be liable to you for indirect

and consequential loss (including without limitation for loss of revenue, loss of profits, failure to

realise expected profits or savings and any other commercial or economic loss of any kind) or loss or

corruption of data, in contract, tort, under any statute or otherwise (including negligence) arising

from or connected to this agreement.

To the extent permitted by law and any rights to which you may be entitled under the returns policy

above, our liability to you for any loss or damage arising out of or in connection with the supply of

goods or service under this Agreement, your use of the Site or any breach by us of this Agreement

however arising (whether for breach of the terms of this Agreement, tort (including negligence),

statute, equity otherwise at common law or on any other basis) is limited to the replacement of the

goods, the supply of equivalent goods, the repair of the goods; the payment of the cost of replacing

the goods (or of acquiring equivalent goods), or the payment of the cost of having the goods

repaired.

Supply of Your Products

Subject to these terms and conditions, we will supply to you the products indicated on your order

confirmation. In certain circumstances, we may need to reject your order, including but not limited

to where the requested product is not available or if there is an error in the price or the product

description posted on the website.

We do ship internationally.
